These Terms and Conditions (“Terms”) govern all renovation, design, and construction services (“Services”) provided by Gia’s Renovations (“we,” “us,” “our”) to you, the client (“you,” “your”). By engaging our Services, you agree to be bound by these Terms.


1. Scope of Services

We will provide the Services as outlined in your quotation, proposal, or contract.
Any additional work outside the agreed scope will be subject to a separate written agreement and may incur extra charges.


2. Quotes & Pricing

  • All quotes are valid for 30 days unless stated otherwise.
  • Prices are inclusive/exclusive of GST (as stated in your quote).
  • Any changes requested by you after acceptance of the quote may result in revised pricing.

3. Payments

  • A deposit is required before commencement of Services.
  • Progress payments will be required at agreed milestones.
  • Final payment must be made upon completion of Services.
  • Late payments may attract interest and/or suspension of Services.

4. Cancellations & Variations

  • You may request changes to the scope of Services; however, all variations must be agreed to in writing and may affect timelines and costs.
  • If you cancel the project after acceptance, you may be liable for:
    • Costs of work already completed
    • Materials ordered
    • A cancellation fee may apply.

5. Client Responsibilities

You agree to:

  • Provide accurate and complete project information
  • Ensure site access during agreed working hours
  • Obtain all necessary consents, permits, and approvals (unless stated otherwise)
  • Maintain appropriate insurance coverage for your property during works

6. Warranties & Guarantees

  • We provide warranties in line with the Building Services (Registration) Act 2011 (WA) and Australian Consumer Law.
  • Manufacturer warranties apply to materials and products supplied.

7. Liability

To the maximum extent permitted by law, we are not liable for:

  • Pre-existing structural or site conditions
  • Delays caused by third parties, weather, or supply chain issues
  • Incidental or consequential loss, including loss of use or profit

Nothing in these Terms excludes your rights under the Australian Consumer Law.


8. Delays

Project timelines are estimates only.
We are not liable for delays beyond our control, including supply shortages, weather, or regulatory approvals.


9. Termination

We may terminate this agreement if:

  • You fail to make payments when due
  • You breach these Terms and do not remedy within 14 days of notice
  • You may terminate for our material breach if not remedied within 14 days.

10. Intellectual Property

All designs, drawings, and documentation prepared by us remain our intellectual property until full payment is received.
You may not use, reproduce, or share our designs without our prior written consent.


11. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through negotiation in good faith.
If unresolved, disputes may be referred to mediation before litigation.


12. Governing Law

These Terms are governed by the laws of Western Australia.
Any disputes will be subject to the jurisdiction of the courts of Western Australia.
